BUYING PRODUCTS ON OUR WEBSITE
By placing an order with the TOTHBORI online store you acknowledge you have read, understood and agree to these Terms and Conditions. If you are unhappy with any aspect of the terms and conditions, then you should contact us at customers@tothbori-official.com before placing your order with us.

PAYMENT PROCESS
1. Online bank card payment | SimplePay
SimplePay is an online payment service of OTP Mobil Ltd., Hungary. Payment is possible with any bank cards. No need for Simple account or any registration.
You acknowledge the following personal data stored in the user account of TOTHBORI Kft. (Company address: H-2112 Veresegyház, Árpád u. 11.) in the user database of www.tothbori.hu will be handed over to OTP Mobil Ltd. (H-1143 Budapest, Hungária körút 17-19.) and is trusted as data processor.
The data transferred by the data controller are the following:
Billing details for invoicing: First name; Last name; Postcode / ZIP; Town / City; Street address; Country; Phone; E-mail address;
Data for delivery/shipping: First name; Last name; Postcode / ZIP; Town / City; Street address; Country;

2. Bank transfer
After choosing the products fill the billing and delivery details on the CHECKOUT page.
In the „Your Order” section please choose the „Direct Bank Transfer” where You can find our bank account details.
To place your order push the PLACE ORDER button.
Make your payment directly into our bank account.
Please use your Order ID as the payment reference.
Your order will not be shipped until the funds have cleared in our account.
We send a confirmation email when the payment arrived. You have 3 days to cancel your order after payment.
We send a confirmation when the goods are ready via e-mail.
We send the product and the INVOICE.
You get the product and a little surprise!
We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order creates a legally binding contract between us. All contracts are concluded in English.
We have the right to revise and amend these Terms and Conditions from time to time to improve our services.
PRICES AND VAT
Orders Delivered Worldwide.
All prices on the TOTHBORI online store are given in EURO and are inclusive of VAT. The total amount of the order including VAT and shipping cost options is displayed in the confirmation email before the payment.
You must make payment for the goods at the time of the order. The price of any product is the price in force at the date and time of your order. We reserve the right to change the price of any product before you place an order. We will inform you if a product's actual price is higher than that stated in your order and you may cancel the order at that time.
Please note that your order may be subject to import duties and taxes over which we have no control as they are levied by your tax and customs office. Where applicable you may be given the choice to pay import duties and taxes in advance at checkout. As the customer and importer of the goods, you will be responsible for these charges. Import duties or tax costs not paid for in advance will be invoiced to you directly from the appointed forwarder. TOTHBORI is not responsible for any delays on goods that have been held back as a result of procedures carried out by your local customs authorities. Please see the shipping guide for current delivery costs and delivery dates.
AVAILABILITY
All apparel items are subject to preorder. We will inform you as soon as possible if the goods you have ordered are not available. All statement accessory items are subject to availability.
DELIVERY
We aim to get your goods to you as soon as possible but cannot accept any liability if the goods are late due to unforeseen courier problems. We will not accept responsibility or liability for non-delivery or any other breach of our obligations under these Terms and Conditions if such breach is caused by circumstances beyond our control.
RETURNS
Our Returns Policy as set out on this website is incorporated into these Terms and Conditions.
Exchange/return is possible within 30 days in original condition, provided with the member, together with an invoice. When purchasing online, the invoice is printed and included in the box. In case of sale, you must purchase at least the same amount as the value of the returned product.
Returning to the store is at your own expense, but the product/products can also be brought in personally. The refund is made to the bank account number specified by the customer, which must be sent to the email address customers@tothbori.hu. Refunds are made within 5 days of receipt of the product.
ACCURACY OF CONTENT
We take every care to ensure that the description and specification of our products are correct at the time of publication. However, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you. Orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. We shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.
OWNERSHIP OF RIGHTS
All rights, including copyright, in this website are owned by or licensed by Tóth Borbála. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Tóth Borbála. You may not modify, distribute or re-post anything on this website for any purpose.
GENERAL
If any court or competent authority decides that any of the provisions of these Terms and conditions are invalid, unlawful or unenforceable to any extent, the term or condition will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
If we fail, to insist that you perform any of your obligations under these Terms and conditions, or if we do not exercise any of our rights or remedies under these Terms, that will not mean that we have waived such rights or remedies and it will not mean that you do not have to comply with those obligations. If we do waive a default by you, that will not mean that we will automatically waive any subsequent default by you. No waiver by us of any of these Terms shall be effective unless we expressly say that it is a waiver and we tell you so in writing.
A person who is not party to these Terms shall not have any rights under or in connection with them under the Contracts.
These Terms shall be governed by Hungarian law and we both agree to the non-exclusive jurisdiction of the Hungarian courts.
This website, these Terms and Conditions and any contract entered into by the parties as a result of use of this website shall be governed by and construed in accordance with Hungarian Law. We both agree to submit to the exclusive jurisdiction of the courts of Hungary.
